Man suspected of impaired driving in fatal pedestrian accident

No matter what time of year or what type of weather strikes in Arizona, residents and visitors frequently travel by foot. For some this is a safe, economical and convenient way to get around. Although it is usually safe for pedestrians to travel near busy roadways, this could also be a major risk that could result in a serious pedestrian accident. If a driver is traveling too fast, fails to stop or yield at traffic signs or is distracted, the driver could collide with a pedestrian resulting in serious injuries or even death.

The Goodyear Police Department recently responded to a fatal accident that resulted in the death of a pedestrian and the arrest of the 39-year-old driver involved in the crash. According to preliminary reports, a man in his 50's was crossing the street near the intersection of Litchfield Road and LaCanada when a semi-truck traveling northbound on Litchfield Road stuck the man.

Emergency crews arrived at the scene and assessed those involved. The man struck by the truck was killed in the crash. Authorities also suspect that that driver of the truck was impaired. That man was arrested but was later released. Charges are pending until the results of the blood tests are received. The accident remains under investigation

In addition to facing criminal penalties, the driver could also face civil liability. The loved ones of the deceased pedestrian might have a cause of action. They could file a wrongful death lawsuit, which could result in compensation being awarded. This could be used towards expenses associated with the crash, such as funeral costs, lost wages and other damages.

A fatal accident can be a very emotional event for loved ones to cope with. It is often devastating to lose a loved one, and the accident that caused their death might leave family members with numerous bills. Those contemplating a cause of action should understand their options. Doing so could help protect their rights and interests and determine whether or not to file for compensation.
