Motorcyclist killed on Bell Road/Grand Avenue Work Zone Detour

On April 2, 2016 a motorcyclist was killed on Greenway Road near Litchfield Road, on a detour route, following a closure of a section of Bell Road in Surprise. An unlicensed teenager drove a SUV and rear ended the motorcycle.

During a period of three days eight other accidents occurred on or near that route.

The driver may have been inexperienced, inattentive, there has also been increased traffic on Greenway Road due to the Bell Road closure.

Seattle Archdiocese Sexual Abuse 9.1 Million Dollar Settlement

The Seattle Archdiocese has settled a sexual abuse case brought by eight women who alleged that they were molested by a priest four decades ago. The case settled for 9.1 million dollars.

A psychiatrist's letter was discovered, along with other documents, reporting that a priest was a pedophile, who needed to be removed from the parish, as soon as possible. The letter was written in 1962, the women were abused between 1968 and 1975.

Pedestrian and Traffic Deaths Have Risen

Pedestrian deaths rose approximately 10 percent last year, as gas prices lowered and motorists drove more.

The Governors Highway Safety Association also states that use of cellphones distracting drivers and walkers may also be partially to blame for rising pedestrian fatalities.

Total traffic deaths were also up an estimated 8 percent last year. Pedestrian deaths account for 15 percent of all traffic deaths.

The Importance of Underinsured Motorist (UIM) Coverage in Arizona

Based upon numerous recent personal injury settlements for clients of mine, it is clear that adequate underinsurance (UIM) coverage is critical for those seriously injured by negligent motorists.

Priest Sexual Abuse in the Phoenix Catholic Diocese and the Movie Spotlight

The movie Spotlight is about the Boston Globe investigation into allegations of sexual abuse by dozens of priests in the Catholic Church in Boston. Similar issues have plagued the Phoenix Diocese.

The investigation revealed a longstanding cover up of priest sexual abuse of children. The Globe found that priests were moved from parish to parish across the country.

The movie ends with a list of places in the United States and around the world where abuse by priests has occurred, Phoenix was listed.

Settling a Personal Injury Claim Too Soon Can Be a Big Mistake

It can be a big mistake to settle a personal injury claim too soon, before adequate information is obtained about the nature and extent of the injuries sustained and further treatment that may be appropriate.

The general rule is that when a claim is settled, signing a release is required. No further compensation for damages is payable, the settlement is final.

A recent case of mine provides quite an example. An insurance company offer of $400.00 turned into a settlement of $115,000.00!

Pop Warner Settlement Regarding Brain Injury

Pop Warner is the country's largest youth football league. It recently settled a lawsuit with a family whose son played in the league and who later committed suicide. There were findings of degenerative brain disease, chronic traumatic encephalopathy, (CTE) which is linked to repetitive head trauma.

The family's son played Pop Warner football for four years. The decedent killed himself at age 25, he also played high school football.

Arizona Cellphone Use by Teen Drivers

AAA Arizona has endorsed passage of Arizona House Bill 2241, which would prohibit teens from using cell phones while driving a vehicle with a learner's permit and during the first six months of the Graduated Driver License phase There is an exception for emergency situations.

The argument in favor of the bill is that driving is a complex skill that must be practiced, that a teen driver's lack of experience plus risk taking behavior increases the risk for crashes.

Older Adult Drivers and Fatalities, Injuries

In 2012, there were almost 36 million drivers aged 65 and older in the United States. More than 5,500 older adults were killed and more than 214,000 were injured in motor vehicle crashes.

Age related declines in vision and cognitive functioning and physical changes may affect some older adults' driving abilities.

Data further provides that older adult drivers ages are less likely to drink and drive than drivers 21 to 64.
