Drunk Driving

Drunk driving crashes kill more than 10,000 Americans each year, that equals 30 people a day, or one person every 50 minutes. Generally, it is illegal to drive with a blood alcohol content or BAC of 0.08 g/DL or higher.  One-third of all traffic crash fatalities involve drunk drivers.  Men are more likely than women to be driving drunk in fatal crashes, according to the National Highway Traffic Safety Administration. Drunk driving claimed the lives of 4,675 motorcycle riders in 2018, of those riders, 1,213 or 26% were legally drunk. Furthermore, the 40+ age group made up 53% of drunk motorcyclists killed.  Teens also face a higher risk of death from drunk driving. In 2018, 24% of young drivers 15 to 20 years old who were killed in crashes had alcohol in their blood. Drugs, both legal and illegal, also impair driving as they affect coordination, judgment and reaction times.  For example, cocaine and methamphetamines make drivers more aggressive and reckless.  Some prescription and over-the-counter medicines can cause drowsiness, dizziness and other side effects that impair driving performance. If you or a loved one is the victim of an accident in which alcohol or drugs is suspected to be involved, contact a personal injury lawyer, who can investigate liability claims and damages claims.

Motor Vehicle Accident Fatalities Involving Blood Alcohol Levels Below Legal Limit

A new study found that approximately 15% of drivers involved in a road death while under the influence of alcohol have a blood alcohol level below the legal limit to drive.

From 2000-2015, 37% of over 600,000 motor vehicle deaths involved at least one driver under the influence of alcohol. 15% of the traffic deaths involved an intoxicated driver under the legal blood alcohol concentration limit. 55% of the deaths involved passengers other than the drinking driver.

The study also found that crashes involving a driver with blood alcohol levels below the 0.08% legal limit were more likely to result in the deaths of young adults or teenagers.

The U.S. National Transportation Safety Board and the U.S. National Academies of Sciences, Engineering, and Medicine have recommended reducing the legal blood alcohol level limit from 0.08% to 0.05%.  A decline in traffic crashes has been seen in other countries that have adopted the 0.05% limit.

The majority of research done regarding accidents involving drivers under the influence of alcohol focus on blood alcohol levels over the 0.08% legal limit, however, driver impairment can begin at a blood alcohol level as low as 0.03%

An emergency physician at Lenox Hill Hospital in New York City, Dr. Robert Glatter, stated that “the bottom line is that if you drink any amount of alcohol, you should not be behind the wheel.”

A personal injury lawyer can investigate liability and advise a crash victim regarding injury claims.
